I initially spoke an agent of La Familia Insurance ("LFI") on May 7, 2022.  This agent's name is "Luz." The majority of my conversation with Luz was conducted via text messaging, so I have documented evidence.

I instructed Luz that I wanted two particular automobiles insured under a six month policy covering myself and my wife:

(1) liability and uninsured motorist coverage on a Ford Focus, and

(2) comprehensive, collision and uninsured motorist with a $1,000 deductible on a Ford Taurus.

For this coverage, Luz quoted me an initial payment of $274 and monthly payments of $180.96. I agreed to this payment schedule for this coverage and I made the initial payment.

Upon receiving a completed copy of my policy on May 7, 2022, I discovered that

(1) its terms exclude myself and my wife from coverage (making the entire policy pointless), and

(2) it explicitly rejects uninsured motorist coverage I explicitly said I wanted.

I brought these problems to Luz's attention, at which time she represented that the problems were the result of a "system error" and "non problem[s]." I asked that Luz provide me with a corrected copy of the policy, and she agreed.

On on May 9, 2022 I again contacted Luz to request a corrected copy of my policy. Luz indicated that she was waiting to hear back from "the company" (the insurance provider) on this matter. Later on this day I received a new copy of the policy that still lists myself and my wife as excluded from coverage and rejects uninsured motorist coverage. I brought this continued problem to the attention of Luz. To date I've heard nothing further from Luz; however, she apparently forwarded this matter to LFI's Paola Olguin on the same day.

On May 9, 2022, Paola contacted me by phone and represented to me that the policy's "declaration page" at issue no longer listed myself or my wife as excluded from coverage, and Paola forwarded me a copy of this purportedly new page. At this time I was out of town attending a family member's surgery, staying in a hotel and unable to access my email until I returned home on the evening of May 12, 2022.

On May 12, 2022, when I returned home as said above, I checked my email and found two messages in my inbox: (1) a message from Paola with an attached copy of the purportedly new declaration page that Paola and I had discussed three days prior in a phone call, and (2) a new policy copy relayed to me by the third party, "PandaDoc."

While the declaration page Paola sent me no longer listed myself or my wife as excluded from coverage, a different page in the full policy sent through PandaDoc still (1) listed myself and my wife as excluded from coverage, and (2) rejects uninsured motorist. On this day I brought these still-existing problems to Paola's attention by highlighting the problem PDF page in the policy and emailing Paola the entire annotated policy. Paola did not respond.

On May 14, 2022, I again emailed Paola for a resolution and indicated to her that I was about to take certain actions, including filing this complaint, if the problems weren't resolved.  To date Paola has not responded; however, she apparently forwarded this matter to LFI's Abel Castro on the same day.

On May 14, 2022 I received an email from Abel apologizing for the "misunderstanding," informing me that he is looking into the matter, and asking me to give him until the morning of May 16, 2022 to resolve the matter.  I've since heard nothing further from Abel nor from anyone else at the LFI, despite leaving a voice message for Abel on May 14, 2022 and subsequently emailing him.

As a result of the above and foregoing (1) I've paid for an insurance policy, but don't have coverage, (2) I can't get insurance elsewhere because the money I had budgeted for insurance is now in the hands of LFI, and (3) LFI is now completely ignoring my attempts to resolve the aforesaid issues.

Luz led me to believe that I would be getting certain insurance coverage.  I relied on Luz's representations.  I acted on Luz's representations.  Luz's representations are material in that they influenced my decision to purchase certain insurance coverage that I thought I was getting.  Luz's representations are material in that she made them knowingly or recklessly. 

Based on Luz's representations, I paid for certain insurance coverage.  I did not get and do not have the insurance coverage for which I paid.  LFI has been completely ineffective and useless in getting me the insurance coverage for which I paid.  It has since come to my attention that Luz's aforesaid representation that "system error" is the cause of the legal terms of my final insurance policy differing from those in the documents I signed online, and that such is a "non problem," is a lie she told me because she didn't understand the problem, didn't want to deal with the problem, or thought I was too naive to pursue the problem.  I believe that these actions on the part of LFI constitute, at minimum, fraudulent inducement, fraudulent misrepresentation and deceptive trade practices.
